
Current consultation activities
On 29 October the Attorney General and Minister for Industrial Relations tabled in Parliament an exposure draft of the Surrogacy Bill 2009 (the Bill), which will decriminalise altruistic surrogacy and provide a legal mechanism for the transfer of the parentage of the child from the birth mother to the intended parents. The Explanatory Notes to the Bill were also tabled and provide an outline of the objectives of the surrogacy reforms and further information about the provisions in the Bill.
The Bill also includes amendments to the Status of Children Act 1978 to include the female de facto partner of the birth mother as a parent of the child, in circumstances where the birth mother has used a fertilisation procedure, (including self insemination), to conceive the child with the consent of her female de facto partner.
It is currently intended that the Bill will be introduced in the Parliament by the end of the year.
