
Appeal Costs Fund
The Appeal Costs Board is established under the Appeal Cost Funds Act 1973 and the Appeal Costs Fund Regulation 1999. The board deals with applications from parties to civil and criminal actions for payment out of the fund for costs of certain appeals and failed proceedings.
The board comprises:
- a chairperson - usually an officer of our department
- two members - nominated by the Bar Association of Queensland and the Queensland Law Society.
The board meets about 10 times a year, depending on how many files it has to review.
Provided all documents have been made available, your application will be referred to the board at the next scheduled meeting. It could take between six weeks and two months to determine the matter from the time the board's executive officer receives all necessary information and advice.
Most applications are made under Section 16 or Section 22 of the Appeal Cost Fund Act 1973. For information about making an application under another section, please contact the executive officer of the board.
