Homeless people

The Homeless Persons Court Diversion program is designed to divert homeless people from the criminal justice system and help them get back on their feet. The program is part of our government’s integrated response to homelessness.

Magistrates at the Brisbane Arrest Courts can refer adults charged with public order offences to health, accommodation and other specialised services when they believe their offences are related to their homelessness.

Offenders who have committed sexual or serious violent offences are not eligible to take part.

Special Circumstances List

The program, through the Special Circumstances List, provides additional assistance for those who suffer from the additional challenges of having impaired decision-making capacity as a result of mental health issues, intellectual disability, brain or neurological disorders.

The list is based on a problem solving approach and involves partnerships with services for homeless people in inner city Brisbane, such as accommodation, mental health and welfare services.
