Review of Right to Information and Privacy laws

Activity occured prior to the current government

The Right to Information Act 2009 (the RTI Act) and the Information Privacy Act 2009 (the IP Act) commenced on 1 July 2009 after a comprehensive and independent review of the Freedom of Information Act 1992. As required by those Acts, the Department of Justice and Attorney-General (the Department) started a review of the RTI Act and the IP Act by 1 July 2011.

Feedback is now invited on two discussion papers prepared as part of this review. One paper considers the RTI Act and the access and amendment provisions of the IP Act. The other considers the IP Act’s privacy provisions. The papers aim to identify the key issues and challenges raised in the legislation. We are now seeking the views of interested people, agencies and organisations on the questions raised.

Submissions provided to the Department in relation to this Discussion Paper will be treated as public documents. This means that in all but exceptional cases, they may be published on the Department’s website, together with the name and suburb of each person making a submission. We may provide your submission to others with an interest in the review, for example, the Parliamentary Committee If you would like your submission, or any part of it, to be treated as confidential, please indicate this clearly. Please note however that all submissions may be subject to disclosure under the RTI Act, and access applications for submissions, including those marked confidential, will be determined in accordance with that Act.
