Recent regulatory impact statements

This proposed code has been developed to assist outworkers to receive their proper entitlements by ensuring transparency in the production chain. The mandatory code will impose reporting obligations on participants as an effective way of identifying the actual employer of the outworker.

The proposed Mandatory Code will not apply to parties involved in the supply of garments for public sector contracts. Neither will it apply to retailers that are signatories to, or manufacturers that are accredited and compliant with, the national Homeworkers’ Code of Practice. The Mandatory Code will operate in conjunction with existing legislative and award protections. 

The Code will help in achieving a previous commitment to create consistency in the regulation of this industry across the eastern seaboard. Cross-border consistency will benefit parties that operate nationally, help create a level playing field and prevent less scrupulous clothing manufacturers from having clothing work performed in a jurisdiction with less strict regulatory requirements.

Consideration of issues raised
After the public comment period closes, the government will consider issues raised by members of the community. Further consultation may occur to address any concerns raised by the community prior to the development of a final position by the government.
