Summary of the Code’s requirements

The Code places obligations on each party (except the outworker) for every order of clothing products made in Australia and intended for retail sale in Queensland. These obligations apply even if outworkers are not used. A summary of the Code’s requirements is provided below.

Retailer Supplier Contractor

Establish where the clothing products were made

Establish whether the clothing products were made in Australia.

Tell the retailer whether the clothing products were made or will be made in Australia.

 

Use of outworkers

Establish whether the supplier or anyone they with contract with used outworkers to make the clothing products.

Tell the retailer whether any outworkers were or will be used to make clothing products and give an undertaking to the retailer about the use of outworkers

Tell the supplier whether any outworkers were or will be used to make clothing products and give an undertaking to the supplier about the use of outworkers (as set out in Form 4A).

Only enter into an agreement with suppliers who comply with their own obligations under the Code.

Only use contractors who comply with their own obligations under the Code.

Provide details to the supplier (as set out in Form 2).

Give the retailer information about any contractors they may have used and whether these contractors used any outworkers (as set out in Form 3).

Reporting requirements

Report in writing to the Department of Justice and Attorney-General and the relevant union, any suspected instances of outworkers being employed on less favourable terms and conditions than those provided under a relevant industrial agreement.

Tell the retailer of any changes to the agreement or if there is false or misleading information.

Tell the supplier of any changes to the agreement or if there is false or misleading information.

Report twice a year to the Department of Justice and Attorney-General and the relevant union by providing a list and details of suppliers they have entered into an agreement within the last six months. Refer to Form 1.

Give information to the retailer to help the retailer comply with their obligations.

Give information to the supplier to assist the supplier to comply with their obligations.

Record keeping

Keep and maintain records as provided by the supplier about the manufacture of clothing products for six years.

Keep all records about an agreement for six years.

Keep all records about an agreement for six years.

Provide records for inspection as required by the Code to an industrial inspector and/or the relevant union.
