Mediation for separating couples
When a relationship breaks down, you have to make a lot of decisions about the future all at once. It can be a very stressful time.
Partners who are separating may argue over things like property settlement, care of the children, child support and other financial matters. These disputes have traditionally been handled by the legal system, but the costs, both emotionally and financially, can be high.
Our dispute resolution centres offer mediation as an alternative.
Mediation is a free, confidential and voluntary dispute resolution service. It is a way of settling disputes by helping the people involved to discuss their differences in the presence of trained mediators and to work out their own solution.
The mediators act as an impartial third party, keeping the discussion focused and helping to clarify the issues.
Role of solicitors
You do not need a solicitor but you should get legal advice about your rights and responsibilities before attending a mediation session. You need to know what the law says about such issues as the division of property and assets, and parental responsibilities in relation to children.
The law on separation and divorce applies throughout Australia, so your rights and responsibilities are the same whatever state you live in.
Violent partners
Remember, you do not have to put up with violence. Laws in Australia provide people with protection against violence wherever it occurs. Violence against a partner is an offence and should not put up with it. The same applies to violence against children, and also to threats, damage to property, deprivation of liberty, and constant criticism or humiliation.
