The Commissioner's office

The role of the Office of the Commissioner of Body Corporate and Community Management is to assist people who live, work or invest in community titles schemes in accordance with the powers conferred on it by the (the BCCM Act).

BCCM dispute resolution service

The BCCM Act states that the Commissioner's office must provide a dispute resolution service. The dispute resolution service:

  • Encourages parties to resolve disputes themselves through self resolution
  • Encourages parties to engage in conciliation in an attempt to settle the dispute without the need for a formal order
  • Resolves disputes through adjudication, in the event that the matter cannot be settled.

Adjudicator's decisions

Whilst the subject of these adjudicator's decisions may not necessarily relate directly to situations within your own body corporate, they may provide you with general information as to how the adjudicator may make orders that are just and equitable, and an idea of how the dispute resolution process operates.

Online training

The online training course has been designed for committee members, however any person with an interest in community titles schemes established in Queensland can participate.

The course provides information on key aspects of body corporate management in Queensland and contains assessment tools participants can complete in their own time.

This is not an accredited course and no qualification is attached to the completion of the course.

BCCM seminars

The Office of the Commissioner for Body Corporate and Community Mangement conducts seminars focussing on providing general information about bodies corporate and how to avoid and resolve disputes.

Information service

The BCCM Act states that the Commissioner's office must provide an information service. The information service:

  • provides information on the BCCM Act and its associated modules in response to telephone, written and in person enquiries
  • produces information brochures and fact sheets dealing with topical issues
  • conducts information seminars throughout Queensland to raise awareness of the legislation and the services provided by the Commissioner's Office.

Maintenance of common property and lots

The BCCM Act and its associated regulation modules provide that the body corporate must maintain the common property, and owners of lots must each maintain their lot.

The cost of maintaining common property forms part of the annual budget set by the body corporate.

Regulation modules

There are four regulation modules which cater for the different types of schemes that can be established under the BCCM Act. The modules are the Standard Module, Accommodation Module, Commercial Module and Small Schemes Module.

Searches

The public may search for adjudicator's orders made in relation to particular community titles schemes. Searches of Community Management Statements can be obtained from the Department of Environment and Resource Management - Property, titles and valuations.
