Government directs development of new legislation (Stage 2)

In June 2025, the Queensland Government announced significant reforms to Queensland’s criminal procedure laws, directing the development of a new Criminal Procedure (Magistrates Court) Bill to replace the Justices Act 1886.

The framework for the criminal procedure reforms is outlined in a comprehensive report by retired District Court judge Mr Michael Shanahan AM, who led the Criminal Procedure Review.

After extensive consultations with the judiciary, legal practitioners and other key stakeholders, Mr Shanahan delivered the review’s summary report in May 2023. Presented in Volume 1 and Volume 2, the report provides detailed recommendations for a modern and effective legislative framework to replace the outdated Justices Act.

The government supports most of the report’s recommendations, and work is now underway to draft the new Criminal Procedure (Magistrates Court) Bill and a related Consequential Amendments Bill.

While the review recommended that magistrates and the Magistrates Courts be retitled as ‘local court judges’ and ‘Local Courts’, the name and titles are remaining. The Magistrates Court and magistrates are recognised terms at the foundation of Queensland’s justice system.

Key highlights of the reform

As a top priority for the department, the Criminal Procedure (Magistrates Court) Bill a significant reform for Queensland’s justice system.

The new Bill will focus on efficiency, greater consistency, improved clarity, and reducing unnecessary delays.

The reforms align with the government’s vision for a justice system that prioritises the rights of victims, is efficient and fair, and makes our community safer.
