Draft new criminal procedure legislation (Stage 3)

The drafting phase is a crucial step in the reform process, where supported recommendations from the Criminal Procedure Review are transformed into detailed legislation.

A modern Criminal Procedure (Magistrates Court) Bill is being developed to replace the outdated Justices Act 1886.

A related Consequential Amendments Bill is also needed to ensure recognition and compatibility of the new framework across Queensland legislation.

Mr Michael Shanahan AM, who completed the review, has returned to provide expert criminal law guidance and knowledge.

The process focuses on making the criminal procedure laws clear, consistent, and easy to understand for everyone.

What’s next

The Criminal Procedure (Magistrates Court) Bill will go through public consultation, giving the community a chance to provide feedback before the laws are introduced into the Legislative Assembly.
