Consultation on the Building Units and Group Titles and Other Legislation Amendment Bill

You are invited to make a submission about the draft Building Units and Group Titles and Other Legislation Amendment Bill 2022 (the draft Bill).

While the Body Corporate and Community Management Act 1997 (BCCM Act) applies to most community title developments in Queensland, the Building Units and Group Titles Act 1980 (BUGT Act) continues to apply to particular developments established under a combination of the BUGT Act and special planning laws (known as the ‘specified Acts’), such as the Mixed Use Development Act 1993 (MUD Act).

The draft Bill contains proposed amendments to improve the operation of the BUGT Act and MUD Act, including to make body corporate governance arrangements fairer for owners. A number of the changes are based on existing provisions of the BCCM Act and regulations.

If Parliament passes the Bill, the proposed amendments to the BUGT Act will apply to all bodies corporate currently governed by the BUGT Act, including subsidiary bodies corporate created under the BUGT Act for any of the ‘specified Act’ developments.
